Terms of Service
Last updated: 30 September 2026
These Terms of Service ("Terms") govern access to and use of the products, platforms, infrastructure, websites, software, APIs, hosting, networking, security services, and other services operated or provided by auth.ink.
auth.ink is operated by Tamir Awad, an individual trading as auth.ink, registered in Israel as an exempt dealer (osek patur). auth.ink is a sole proprietorship and is not a limited company or corporation.
By accessing or using a Service covered by these Terms, you agree to these Terms and to any additional terms that specifically apply to that Service.
1. About These Terms
1.1 auth.ink as the Umbrella Provider
auth.ink operates multiple products, brands, and services.
These include, among others:
- League Hosting;
- Roaming;
- protected.cx;
- Edge Transit;
- Core;
- FortuneDB;
- infrastructure, networking and security services;
- APIs, software and management platforms;
- consulting and managed infrastructure services; and
- other products and services operated by auth.ink from time to time.
Some Services have their own product-specific Terms of Service.
Where a Service has product-specific terms, those terms form part of your agreement with auth.ink together with these Terms. Agreeing to the applicable product-specific terms also incorporates these Terms.
1.2 Priority of Terms
If different documents conflict, the following order of priority applies:
- a separately signed agreement that expressly states that it overrides these Terms;
- product-specific Terms of Service;
- these auth.ink Terms of Service;
- general website content, documentation and other general materials.
Plan, order and service details may additionally define commercial and technical matters such as pricing, resources, traffic allowances, service location, features and limits.
An informal conversation, support message, ticket, quotation or other communication does not override these Terms unless it expressly states that it modifies the applicable agreement and auth.ink has agreed to that modification.
1.3 Mandatory Rights
Nothing in these Terms removes or limits any right or remedy that applicable law does not permit us to exclude or limit.
Where mandatory consumer law gives you greater rights than these Terms, the mandatory law applies.
2. Eligibility
2.1 General Minimum Age
Unless a specific Service provides otherwise, you must be at least 13 years old to use the Services.
You must also have the legal capacity required under the law applicable to you to enter into the relevant transaction or use the relevant Service.
Where parental or guardian consent is legally required, you may use the Service only with that consent.
2.2 Product-Specific Requirements
Individual Services may impose a higher minimum age or additional eligibility requirements.
The requirements stated in the applicable product-specific terms control for that Service.
2.3 Businesses and Organizations
Businesses, organizations and other legal entities may use the Services.
A person accepting these Terms for an organization represents that they have authority to bind that organization.
3. Accounts and Access
3.1 Account Information
You must provide accurate information when registering or purchasing a Service and must keep information reasonably necessary for account operation up to date.
3.2 Account Security
You are responsible for maintaining the security of your account, authentication methods, API keys, passwords, tokens and other credentials.
You are responsible for activity performed using credentials issued to you or authorized by you, except to the extent that the activity resulted from a security failure attributable to auth.ink.
You must notify us promptly if you reasonably believe an account or credential has been compromised.
3.3 Subusers and Team Members
If you authorize another person to access your account or Service, including through a subuser, team, employee or similar feature, you are responsible for their permissions and their use of the Service as if the relevant activity were performed by you.
3.4 Account Transfers
You may not sell, transfer, lend or give another person your account or Service access unless:
- the Service provides an official mechanism for doing so; or
- auth.ink has given permission.
This does not prevent the use of authorized subuser, team, reseller or white-label features.
3.5 Identity Verification
We may request reasonable identity or ownership verification where necessary for fraud prevention, account recovery, payment disputes, abuse investigations, legal compliance or security.
Failure to complete a reasonable verification request may result in an order being refused or an account or Service being restricted or suspended.
4. Services
4.1 Digital Services
Unless expressly stated otherwise, the Services are digital services. Nothing is physically shipped.
4.2 Best-Effort Service
Unless a specific plan, product-specific term or signed agreement expressly provides a service level agreement, the Services are provided on a best-effort basis.
We do not guarantee:
- uninterrupted availability;
- any particular uptime percentage;
- error-free operation;
- particular latency;
- continuous connectivity;
- uninterrupted routing;
- uninterrupted access to any specific upstream network;
- that every feature will always remain available; or
- that every fault will be capable of correction.
4.3 Maintenance
We may perform scheduled and emergency maintenance.
Emergency maintenance, security work or protective action may be performed without advance notice where reasonably necessary.
4.4 Service Migration
We may migrate a Service, virtual machine, container, database, IP assignment, application or other workload between hardware, systems, networks or providers for operational, maintenance, capacity, reliability or security reasons.
Unless a specific plan or agreement guarantees a location, we may also change the physical or geographic location from which a Service is provided.
4.5 Changes to Services
We may add, remove, modify, replace or discontinue features, plans or Services.
Changes to future purchases and renewals may include changes to pricing, limits, features, hardware, networking or other technical characteristics.
An already-paid fixed term will not normally be materially reduced before its end unless:
- you agree;
- the change is reasonably necessary for security, abuse prevention or infrastructure stability;
- the change is required by law or an upstream provider;
- continuing the existing configuration is no longer technically practicable; or
- the applicable product-specific terms provide otherwise.
If we permanently discontinue a paid Service without cause before the end of a prepaid term and cannot provide a substantially equivalent replacement, any refund rights are handled under these Terms, the applicable product terms and applicable law.
5. Legacy and Discontinued Products
5.1 Legacy Products
Core and FortuneDB are Legacy Products.
Legacy Products may remain operational, but active development, support and updates may be significantly reduced.
We do not guarantee any development schedule, feature additions or continued long-term availability for a Legacy Product.
5.2 Shield
Shield is discontinued.
Existing deployments may continue to function and we may, at our discretion, release maintenance or security updates.
Continued operation does not mean that Shield remains supported or actively developed.
We do not guarantee continued compatibility, availability, support or future updates for Shield.
6. Pricing, Payments and Taxes
6.1 Prices and Plans
Prices, billing periods, resource allocations and payment methods are determined by the applicable Service, plan, order or product-specific terms.
Unless otherwise stated, payment is required before access to a paid Service is provided.
6.2 Price Changes
We may change prices for future purchases and renewals.
A price change does not retroactively change the price of a fixed term that has already been paid.
6.3 Payment Providers
Payments may be processed directly by auth.ink or through third-party payment processors or merchants of record.
Where a merchant of record processes a transaction, that provider may be the entity that charges you and issues the applicable customer-facing payment document.
6.4 Osek Patur
auth.ink is currently registered in Israel as an osek patur.
We therefore do not charge VAT on transactions for which auth.ink is the seller and current Israeli law does not require us to charge VAT.
Where auth.ink receives payment directly, we issue the accounting documentation required for that payment.
If our tax registration changes, applicable taxes may be added to future transactions as required by law.
6.5 Failed Payments and Amounts Owed
We may suspend or restrict a Service where payment is overdue, reversed, cancelled or otherwise not received.
We may remove service time, account credits or resources that were provided on the basis of a payment that was later reversed or not completed.
7. Consumer Cancellation and Refund Rights
7.1 Application of This Section
This section provides the general cancellation framework for consumers protected by the Israeli Consumer Protection Law, 5741-1981.
A product-specific policy may provide additional cancellation or refund rights.
Nothing in a product-specific policy reduces a mandatory right provided by law.
7.2 Distance-Sale Cancellation
Where the statutory distance-sale cancellation right applies, a consumer may cancel within 14 days from the date of the transaction or from the date on which the consumer received the written transaction information required by law, whichever is later.
Where the Service has already begun, we may charge the proportional amount for the Service actually supplied before cancellation where permitted by law.
Where permitted by law, we may also deduct a cancellation fee of 5% of the transaction amount or ₪100, whichever is lower.
7.3 Defect, Non-Conformity or Breach
Where a cancellation results from a defect, failure to supply the Service as agreed, non-conformity or another breach for which the law prohibits a cancellation fee, no cancellation fee will be charged.
This does not prevent us from charging for a portion of a Service that the law permits us to charge for despite the cancellation.
7.4 Extended Statutory Cancellation Period
Israeli law provides an extended cancellation period of up to four months for certain consumers, including qualifying senior citizens, new immigrants and persons with disabilities, where the statutory conditions for that extended right are satisfied.
We will honor that right where it applies.
We may request reasonable proof of eligibility where permitted by law.
7.5 How to Cancel
Where a statutory cancellation right applies, a cancellation notice may be submitted through the methods we are required to make available by law, including as applicable:
- by telephone;
- by email;
- by registered mail;
- through an online cancellation mechanism where one is provided or legally required; and
- through any additional cancellation channel required by applicable law.
A product may provide additional cancellation methods.
We may request information reasonably necessary to identify you and the transaction.
7.6 Refund Timing
Where the law requires a refund following cancellation, it will be processed within the period required by law.
Where possible, refunds are returned through the original payment method. Where that is not reasonably possible, another appropriate payment method may be used.
7.7 Other Refunds
Outside mandatory cancellation rights, eligibility for a refund is determined by the applicable product-specific terms, plan or written agreement.
We may provide discretionary refunds or credits beyond what is legally required. Doing so in one case does not create an obligation to do so in another.
8. Chargebacks, Fraud and Payment Disputes
If you initiate a chargeback, payment reversal or payment dispute, or if we reasonably identify payment fraud or abuse, we may immediately:
- suspend or restrict the affected Service;
- suspend the account;
- remove unpaid credits, resources or service time;
- prevent additional purchases;
- investigate associated accounts; and
- take reasonable steps to recover amounts legitimately owed.
Resolving or withdrawing a chargeback does not guarantee continued or future service.
To the extent permitted by law, auth.ink may refuse future purchases, renewals or services even after a payment dispute has been resolved.
9. Fair Use and Shared Resources
9.1 General Fair Use
Many Services use shared infrastructure.
Even where a plan advertises or provides a resource as "unlimited", that does not mean that an individual customer receives unlimited dedicated physical infrastructure.
"Unlimited" generally means that the Service does not impose a fixed numerical quota for that resource under normal and reasonable use.
9.2 Resources Covered
Fair use may apply to resources including:
- CPU time;
- RAM;
- storage;
- disk I/O;
- database usage;
- API usage;
- network bandwidth;
- clean traffic;
- connection rates;
- concurrent connections;
- packet rates;
- network sessions; and
- other shared technical resources.
9.3 Harmful Usage
You may use the resources provided by your plan for the intended purpose of the Service.
We may intervene where usage materially affects or threatens:
- other customers;
- shared hardware;
- network stability;
- storage systems;
- databases;
- upstream providers;
- IP reputation;
- DDoS mitigation capacity; or
- the stability, security or availability of the Services.
9.4 Fair Use Measures
Where appropriate, we may:
- contact you regarding the usage;
- throttle or rate-limit resources;
- temporarily limit a feature;
- migrate a workload;
- adjust technical configuration;
- require remediation;
- isolate a workload; or
- suspend the affected Service.
We will generally attempt to notify a customer where practical.
Immediate action may be taken where we reasonably believe the usage is abusive, creates an immediate operational or security risk, or materially threatens other customers or infrastructure.
10. protected.cx and DDoS Protection
10.1 Nature of the Service
protected.cx and related auth.ink network protection services provide traffic filtering, mitigation, protocol validation and related security functions.
No DDoS protection system can guarantee protection against every attack.
The effectiveness of mitigation depends on factors including:
- attack size;
- attack type;
- protocol;
- traffic characteristics;
- customer configuration;
- upstream capacity;
- available filtering methods; and
- whether recommended security practices are followed.
10.2 Clean Traffic
For these Terms, Clean Traffic means traffic permitted through the applicable auth.ink mitigation or filtering systems and forwarded toward the protected customer service.
Traffic identified and dropped by those systems as malicious, invalid or attack traffic does not count as Clean Traffic.
A plan may include a specified amount or capacity of Clean Traffic.
The applicable allowance may be stated in:
- the plan;
- the order;
- a contract;
- product documentation;
- or written communication with the customer, including a support or sales ticket.
Internal mitigation and protection thresholds do not need to be publicly disclosed.
10.3 Exceeding Clean-Traffic Capacity
Exceeding a stated Clean-Traffic allowance does not necessarily result in immediate suspension.
We may allow the additional usage to continue.
We may also throttle, rate-limit or otherwise restrict traffic.
We will generally attempt to notify the customer regarding sustained usage beyond the applicable allowance.
Where we reasonably suspect abuse or the traffic creates risk to infrastructure, customers or upstream providers, we may suspend, isolate or blackhole the affected service or IP address.
10.4 Customer Configuration
Customers are responsible for configuring their protected services appropriately.
This includes, where applicable:
- using appropriate protocol-aware filters;
- closing unused ports;
- maintaining appropriate backend firewall rules;
- restricting services to the ports actually required; and
- following reasonable security recommendations provided by auth.ink.
DDoS protection is most effective when appropriate security practices are followed.
10.5 Generic TCP and UDP Filtering
A customer may request generic TCP or UDP forwarding or filtering without a protocol-aware filter.
By doing so, the customer acknowledges that:
- protocol-specific attacks may be more difficult to distinguish from legitimate traffic;
- the protected service may be easier to disrupt than when an appropriate protocol-aware filter is used; and
- auth.ink may need to take stronger network-level action during an attack.
If traffic threatens our infrastructure, other customers or an upstream provider, we may blackhole or null-route the affected IP address or otherwise isolate the traffic.
10.6 Unused and Unfiltered Ports
Customers should not unnecessarily expose ports that are not required for their Service.
Where an IP address receives attack traffic against unconfigured, unused or insufficiently filtered ports, automated protection systems may blackhole or null-route that IP after internal protection thresholds are reached.
Those thresholds may change as our infrastructure and mitigation systems change and are not guaranteed to be publicly disclosed.
10.7 Emergency Protection
Where traffic, configuration or an attack threatens shared infrastructure, we may immediately:
- blackhole or null-route an IP;
- block ports;
- apply rate limits;
- modify filtering;
- isolate a service;
- change routing;
- suspend connectivity; or
- take another reasonably necessary protective measure.
Advance approval from the customer is not required for emergency protective actions.
Where practical, we will notify the affected customer after taking such action.
10.8 Traffic Inspection
Providing network security and DDoS mitigation necessarily involves processing and inspecting network traffic and related metadata.
This may include protocol information, connection information, traffic characteristics, source addresses, attack information, logs and other data reasonably necessary to:
- identify malicious traffic;
- apply filtering;
- diagnose problems;
- provide traffic statistics;
- prevent abuse;
- investigate attacks; and
- protect infrastructure.
Our Privacy Policy provides further information regarding personal data processing.
11. Network Services, IP Addresses and Edge Transit
11.1 No Ownership of Network Resources
The provision of an IP address, address range, route, prefix or other network resource does not transfer ownership or any property right in that resource to the customer.
The Service provides the customer with access to connectivity or traffic carried through resources made available by auth.ink or its suppliers.
The fact that traffic is routed through an IP address does not mean that the customer owns that address.
11.2 Changes and Reassignment
Unless expressly guaranteed in a signed agreement, a particular IP address or network resource is not guaranteed to remain assigned for any specific period.
We or our suppliers may change, replace, withdraw, reassign, isolate, filter or stop using an IP address or other network resource for reasons including:
- technical changes;
- routing changes;
- provider changes;
- abuse;
- IP reputation;
- security;
- legal requirements;
- upstream requirements;
- maintenance; or
- termination of the underlying Service.
11.3 Routing and Reachability
We do not guarantee:
- any specific network route;
- a specific latency;
- universal reachability;
- availability of every protocol or port at all times;
- that upstream providers will never filter traffic;
- that an IP address will be accepted by every third-party service; or
- that mitigation activity will not temporarily affect otherwise legitimate traffic.
11.4 Reverse DNS
Unless specifically agreed, we do not guarantee the availability or contents of any reverse-DNS or PTR record.
11.5 IP Geolocation
IP geolocation databases are operated by third parties and can be inaccurate or slow to update.
We do not guarantee that an IP address will be identified by third-party geolocation services as being in a particular country, city, region or network.
12. Acceptable Use Policy
You may use the Services only for lawful purposes and in accordance with these Terms.
12.1 Illegal and Malicious Activity
You may not use a Service for activity that is unlawful under applicable law.
You may not use the Services for, among other things:
- malware distribution;
- ransomware;
- spyware;
- credential stealers;
- malicious payloads;
- botnets;
- unauthorized command-and-control infrastructure;
- phishing;
- credential theft;
- impersonation;
- scams or fraud;
- unauthorized intrusion;
- unauthorized exploitation;
- unauthorized brute forcing;
- malicious vulnerability exploitation; or
- other intentionally malicious activity.
12.2 Network Attacks
You may not use the Services to perform or facilitate:
- denial-of-service attacks;
- distributed denial-of-service attacks;
- booters or stressers;
- unauthorized stress testing;
- reflection or amplification attacks;
- unauthorized port scanning;
- network attacks; or
- interference with third-party networks.
Authorized security testing is permitted only where you have lawful authority to perform it and the activity does not violate these Terms or threaten auth.ink infrastructure.
12.3 Spam and Messaging Abuse
You may not use the Services for:
- unsolicited bulk email;
- spam;
- purchased mailing lists;
- abusive SMTP use;
- SMS spam;
- robocalling;
- unsolicited bulk messaging; or
- comparable messaging abuse.
Legitimate transactional messaging and genuinely opt-in communications are permitted.
12.4 IP and Domain Reputation
You may not use the Services in a way that materially harms the reputation of auth.ink IP addresses, domains, networks or upstream resources.
This includes activity that results in significant:
- abuse complaints;
- spam listings;
- blocklist listings;
- malware reputation;
- fraud reputation; or
- other network reputation damage.
We may require remediation or may block, migrate, restrict or suspend a Service where necessary to protect shared IP or domain reputation, even where the underlying activity is not itself unlawful.
12.5 Proxies, Relays and Similar Services
You may not operate public proxies, public VPN services, Tor exit nodes, forwarding services, open relays or similar services without permission where such use is not expressly part of the Service purchased.
12.6 Cryptocurrency Mining and Resource Abuse
Cryptocurrency mining or other unusually resource-intensive computation may be prohibited or restricted unless the applicable Service expressly allows it or auth.ink has approved it.
The Fair Use provisions in section 9 continue to apply.
12.7 Intellectual Property and Piracy
You may not knowingly use the Services to unlawfully distribute copyrighted works, pirated software, stolen material or other content in violation of third-party intellectual-property rights.
12.8 Adult Content
Legal adult or NSFW content is permitted provided that:
- it complies with applicable law;
- it does not involve minors;
- it does not involve unlawful exploitation or non-consensual intimate material; and
- its operation does not materially damage shared network or IP reputation.
12.9 Child Sexual Abuse and Exploitation
Child sexual abuse material, sexual exploitation of minors, grooming infrastructure and other unlawful sexual content involving minors are strictly prohibited.
We may preserve and report relevant information where required or permitted by law and may immediately suspend or terminate associated Services.
12.10 Harassment and Abuse
You may not use the Services for unlawful threats, extortion, blackmail, targeted harassment, unlawful doxxing or similar abuse.
12.11 Security and Technical Controls
You may not intentionally bypass or interfere with:
- access controls;
- authentication;
- resource controls;
- rate limits;
- filtering systems;
- billing controls;
- licensing controls;
- security mechanisms; or
- technical restrictions imposed by auth.ink or its providers.
12.12 Harm to the Service
You may not use the Services in a way that materially harms, overloads, destabilizes or interferes with auth.ink, another customer, an upstream provider or a third party.
13. Reselling and White-Label Use
13.1 Default Rule
You may not resell, sublicense, redistribute, white-label or provide an auth.ink Service onward to third parties unless:
- auth.ink has given prior written permission; or
- the relevant Service is expressly designed and offered for reseller or white-label use.
This includes the resale of hosting, network connectivity, DDoS protection, IP-related services and other infrastructure.
13.2 Approved Resellers
Approved resellers and white-label customers are responsible for their relationship with their own customers, including:
- marketing;
- pricing;
- support;
- representations and promises;
- legal compliance;
- customer content; and
- their customers' use of the relevant service.
Unless auth.ink separately enters into an agreement with the reseller's end customer, the reseller's end customer does not become a direct auth.ink customer merely because an underlying auth.ink Service is used.
13.3 No Authority to Bind auth.ink
A reseller, customer or other third party may not make commitments on behalf of auth.ink unless expressly authorized in writing.
For example, a reseller's promise of particular uptime, unlimited protection, guaranteed mitigation or another performance commitment does not create an obligation for auth.ink unless auth.ink expressly agreed to that commitment.
14. Customer Content, Workloads and Responsibility
14.1 Customer Responsibility
You are responsible for the applications, servers, websites, bots, code, files, databases, users, traffic, configurations and other workloads you choose to run through the Services.
The fact that auth.ink provides infrastructure, hosting, connectivity or protection does not by itself make auth.ink the owner, publisher or operator of your workload or content.
14.2 Legal Rights
You must have the rights and permissions necessary to upload, host, process, transmit or otherwise use content, software and data through the Services.
You are responsible for complying with third-party terms and software licences applicable to software you install or use, including operating systems, game software, plugins, modifications, libraries and other licensed material.
14.3 End-User Data
Where your users' or customers' personal data passes through auth.ink systems as part of a Service you operate, you are responsible for having an appropriate legal basis and any notices or permissions required to collect and provide that data.
The auth.ink Privacy Policy and any applicable data-processing agreement govern auth.ink's handling of personal data.
15. Abuse Reports and Third-Party Complaints
15.1 Abuse Reports
We may investigate complaints relating to Services operated by our customers.
Where appropriate, we may forward an abuse, copyright or other complaint to the affected customer and allow a reasonable opportunity to respond or resolve the issue.
15.2 Immediate Action
We are not required to wait for a customer response before acting where we reasonably believe immediate action is necessary because of:
- serious unlawful activity;
- an active security threat;
- malware;
- attacks;
- fraud;
- urgent harm;
- a binding legal requirement;
- a court or competent authority order;
- an upstream provider requirement; or
- a material risk to auth.ink or third-party infrastructure.
We may preserve, restrict, disable, remove, block, isolate, suspend or report relevant systems, traffic or information as permitted or required by law.
16. Monitoring and Security
16.1 Operational Monitoring
We may monitor information reasonably necessary to operate and protect the Services, including:
- resource usage;
- network traffic and metadata;
- logs;
- security events;
- technical configuration;
- authentication activity;
- API activity; and
- abuse indicators.
Such monitoring may be used to:
- provide the Service;
- troubleshoot problems;
- enforce these Terms;
- investigate abuse;
- prevent fraud;
- protect infrastructure; and
- comply with legal obligations.
This section does not mean that auth.ink routinely reads private customer content where doing so is not necessary for the relevant Service.
16.2 Emergency Security Actions
Where we reasonably believe immediate action is necessary for security or stability, we may, without prior approval:
- block traffic;
- isolate a system;
- disable access;
- revoke or rotate credentials;
- modify firewall rules;
- modify routing;
- change filtering;
- temporarily restrict resources; or
- suspend a Service.
Where practical, we will notify the affected customer afterward.
17. Backups and Customer Data
17.1 Customer Responsibility
Unless a specific agreement provides otherwise, you should maintain independent copies of important data.
Do not treat an auth.ink Service as the sole copy of data that you cannot afford to lose.
17.2 Backup Services
Where auth.ink provides backups, including where a backup feature is separately paid for, the backup service is intended as a supplementary best-effort measure.
Unless a specific agreement expressly states otherwise, we do not guarantee that a backup will:
- exist for every point in time;
- contain every file;
- be current;
- be free from corruption;
- remain available indefinitely; or
- be capable of successful restoration.
A backup feature provided by auth.ink is not a substitute for a dedicated archival, disaster-recovery or premium backup solution.
17.3 Data Loss
Hardware failure, software failure, storage corruption, attacks, provider failures, customer actions and other events can result in loss or corruption of data.
To the maximum extent permitted by law, auth.ink does not guarantee against data loss and liability relating to data loss is subject to the limitations in section 24.
Nothing in this section limits liability that applicable law does not permit us to limit.
18. Retention After Service or Account Closure
18.1 Service Data
We may retain Service data after expiry, suspension, cancellation or termination.
Unless a specific Service expressly provides a guaranteed retention period, we do not guarantee how long terminated Service data will remain available or recoverable.
You should retrieve data you need before ending a Service.
18.2 Account Closure
Closing an account does not necessarily result in immediate deletion of every associated record.
We may disable, de-identify or partially anonymize an account while retaining information reasonably necessary for:
- bookkeeping and accounting;
- transaction history;
- fraud prevention;
- abuse prevention;
- security;
- dispute handling;
- legal claims;
- system integrity; or
- compliance with legal obligations.
Some records may therefore remain associated with an identifier where retaining that association is reasonably necessary.
Our Privacy Policy provides further information about retention and personal-data rights.
19. Software and Intellectual Property
19.1 auth.ink Property
auth.ink and its licensors retain their rights in the Services, including applicable:
- software;
- source code;
- proprietary binaries;
- APIs;
- systems;
- designs;
- documentation;
- trademarks;
- product names;
- branding; and
- infrastructure technology.
Using a Service does not transfer ownership of these materials to you.
19.2 Customer Property
You retain your rights in your own content, files, code, configurations, databases and other materials.
You grant auth.ink a limited, non-exclusive right to host, copy, transmit, process, secure, back up and otherwise handle those materials only as reasonably necessary to provide, maintain and protect the Services or comply with law.
19.3 Reverse Engineering
Reverse engineering of proprietary auth.ink software is permitted only where:
- you possess or are authorized to use a legitimate copy of the relevant software; and
- auth.ink has expressly authorized the reverse engineering.
Authorization may be given through written terms, a website notice, email, contract or another written authorization from auth.ink.
Permission to reverse engineer does not transfer ownership of the software or automatically permit other uses.
19.4 Restrictions
Unless separately authorized, you may not:
- redistribute proprietary auth.ink source code or binaries;
- sell unauthorized copies;
- publish extracted proprietary source code;
- remove or bypass licensing or access controls;
- sublicense proprietary software;
- represent proprietary auth.ink technology as your own; or
- use reverse-engineered proprietary material to create and distribute a directly competing copy of the relevant product.
Nothing in this section limits rights that applicable law expressly provides and does not permit us to restrict.
20. Third-Party Services and Providers
20.1 Dependencies
The Services may depend on third parties including:
- datacenters;
- internet service providers;
- carriers;
- transit providers;
- DDoS scrubbing providers;
- payment processors;
- merchants of record;
- cloud providers;
- software vendors;
- connectivity suppliers; and
- other infrastructure providers.
20.2 Third-Party Failures
Their outages, routing changes, filtering, restrictions, suspensions, failures or other actions may affect the Services.
To the maximum extent permitted by law, auth.ink is not responsible for failures caused by third parties that are outside our reasonable control.
This does not remove obligations that applicable law places directly on auth.ink and does not permit us to exclude.
20.3 Customer-Selected Third-Party Software
We are not responsible for third-party software, plugins, modifications, applications or services that you choose to install or use.
21. Suspension and Termination
21.1 Grounds for Immediate Action
We may immediately restrict, suspend or terminate an account or Service where reasonably necessary because of:
- non-payment;
- payment fraud;
- a chargeback or payment reversal;
- serious abuse;
- unlawful activity;
- malware;
- an attack;
- an immediate security risk;
- a serious AUP violation;
- material risk to infrastructure;
- repeated harmful IP reputation;
- failure to comply with a required identity verification;
- an upstream provider requirement;
- a legal requirement; or
- another material breach of these Terms.
21.2 Ordinary Violations
For an ordinary violation that does not require immediate action, we will generally attempt to notify the customer and provide a reasonable opportunity to correct the issue.
We are not required to provide a cure period where doing so would create material risk or where the violation is serious, repeated or intentional.
21.3 Termination for Cause
Where we terminate a paid Service for cause, amounts already paid are generally not refundable except where applicable law or applicable product-specific terms require otherwise.
21.4 Termination Without Customer Fault
If auth.ink terminates a prepaid fixed-term Service without customer fault and cannot continue providing a substantially equivalent Service, we will provide any refund of the unused prepaid portion required under the applicable agreement or law.
21.5 Refusal of Service and Renewal
Subject to applicable law, auth.ink may refuse:
- a new customer;
- a new order;
- a renewal;
- an upgrade; or
- an additional Service.
This discretion does not permit us to unlawfully discriminate or arbitrarily cut short an existing prepaid fixed term without applying the rights provided by these Terms and applicable law.
22. Support
Support is provided on a best-effort basis through the support channels made available for the applicable Service.
Unless a specific plan or signed agreement expressly states otherwise:
- no guaranteed support response time applies;
- support availability may vary; and
- no dedicated support or response SLA is created by these Terms.
23. Disclaimers
23.1 As Available
To the maximum extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis.
We do not guarantee that every Service will be uninterrupted, error-free, immune from attack, compatible with every third-party system or suitable for every intended purpose.
23.2 Security Services
No security product provides absolute security.
auth.ink does not guarantee that DDoS protection, filtering, firewalls, monitoring, anti-abuse systems or other security products will detect, prevent or mitigate every threat or attack.
23.3 Customer Decisions
You are responsible for how you configure and use the Services and for determining whether a Service is appropriate for your use case.
Technical information, documentation and support provided by auth.ink are not a substitute for professional legal, accounting or other regulated professional advice.
24. Limitation of Liability
24.1 Scope
To the maximum extent permitted by applicable law, auth.ink's total aggregate liability arising from or relating to a particular affected Service is limited to the amount of the most recent payment actually made for that affected Service before the event giving rise to the claim.
Where no payment has ever been made for the affected Service, no contractual monetary liability is assumed except to the extent liability cannot lawfully be excluded or limited.
24.2 Excluded Losses
To the maximum extent permitted by law, auth.ink is not liable for indirect, incidental, consequential, special or similar losses, including:
- lost profits;
- lost revenue;
- lost business;
- lost opportunities;
- business interruption;
- reputational harm;
- indirect loss of data;
- losses caused by third-party services; or
- losses caused by a customer's own software, content, configuration or users.
24.3 Mandatory Exceptions
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.
In particular, these Terms do not exclude or limit liability that cannot lawfully be excluded for matters including fraud, intentional misconduct, gross negligence, or death or bodily injury caused by negligence where applicable law does not permit such limitation.
24.4 Consumer Remedies
This limitation does not remove statutory cancellation, refund or other mandatory consumer remedies.
25. Indemnification
To the extent permitted by law, you agree to indemnify auth.ink against third-party claims, losses, liabilities, damages, reasonable legal expenses and other reasonable costs arising from:
- your unlawful use of the Services;
- your content or workloads;
- your violation of these Terms;
- your violation of a third party's rights;
- your infringement of intellectual-property rights;
- your operation of services through auth.ink infrastructure; or
- representations or promises you make to your own customers.
This section applies only to the extent the relevant claim or loss was caused by your conduct.
It does not require you to indemnify auth.ink for losses caused by auth.ink's own breach, negligence or unlawful conduct.
26. Sanctions and Legal Restrictions
You may not use the Services where doing so would cause you or auth.ink to violate applicable:
- sanctions;
- export-control laws;
- trade restrictions;
- court orders; or
- other binding legal restrictions.
We may refuse, restrict or suspend Services where reasonably necessary to comply with law or a binding restriction imposed on us or an upstream provider.
27. Force Majeure and Events Outside Our Control
To the maximum extent permitted by law, auth.ink is not liable for delay or failure caused by events outside our reasonable control.
Such events may include:
- major internet or routing failures;
- upstream provider failures;
- major DDoS attacks;
- power failures;
- hardware or infrastructure failures outside our reasonable control;
- natural disasters;
- fire;
- war or hostilities;
- civil unrest;
- government action;
- sanctions;
- regulatory changes;
- strikes;
- telecommunications failures; or
- comparable events that could not reasonably be prevented by auth.ink.
We will make reasonable efforts to restore affected Services where practicable.
28. Notices and Communications
Operational, billing, suspension, abuse, security and service notices may be delivered through a contact method associated with your account or Service, including:
- email;
- the customer dashboard;
- a support ticket;
- Discord, where Discord is used for the relevant Service; or
- another communication channel ordinarily used between you and auth.ink.
You are responsible for maintaining access to the communication methods associated with your account.
Formal notices that applicable law requires to be delivered in a specific manner will be delivered in that manner.
29. Changes to These Terms
29.1 Minor Changes
Corrections, formatting changes, clarifications, contact-detail updates and other changes that do not materially reduce customer rights may take effect when published.
29.2 Material Changes
Where reasonably practicable, we will provide at least 30 days' notice before a material change that significantly reduces customer rights or materially increases customer obligations takes effect.
Notice may be provided through the website, email, dashboard, Discord or another appropriate service channel.
29.3 Existing Paid Terms
A material change will not normally be applied retroactively to a fixed paid term that began under an earlier version of these Terms.
The updated Terms will generally apply from the next renewal, purchase or other lawful acceptance of the updated Terms.
Changes that are required by law, necessary for immediate security or necessary to address serious abuse may take effect sooner where reasonably necessary.
30. Governing Law and Disputes
30.1 Governing Law
These Terms are governed by the laws of the State of Israel.
30.2 Informal Resolution
Before commencing formal proceedings, we encourage you to contact [email protected] so that the matter can be reviewed and, where possible, resolved without litigation.
30.3 Courts
Disputes arising from these Terms or the Services may be brought before the competent courts of Israel.
Nothing in this section deprives a consumer of a mandatory right under applicable law to bring proceedings in another competent court or jurisdiction where that right cannot lawfully be waived.
31. General Provisions
31.1 Entire Agreement
These Terms, together with applicable product-specific terms, applicable plan or order information, our Privacy Policy and any expressly controlling signed agreement, form the agreement governing the relevant Service.
31.2 Severability
If a provision of these Terms is found invalid, unlawful or unenforceable, the remaining provisions continue to apply to the maximum extent permitted by law.
31.3 No Waiver
If we do not enforce a provision on one occasion, that does not waive our right to enforce it later.
31.4 Assignment
You may not transfer your rights or obligations under these Terms without our permission.
auth.ink may transfer these Terms as part of a sale, transfer or restructuring of the business, provided that the successor assumes the relevant obligations and the transfer does not remove mandatory customer rights.
31.5 No Partnership or Agency
These Terms do not create a partnership, employment relationship, joint venture or agency relationship between you and auth.ink.
31.6 Language
These Terms are written in English.
Any translation is provided for convenience. In the event of a conflict, the English version controls except where mandatory law requires otherwise.
